INTRODUCTION

1. Establishment – Board of Directors (State):

- 29/10/2012 – Issuance of decision 1624/QĐ-TTg by the State Government regarding the formation of PPP’s Board of Directors.

- 10/11/2916 – Replacement of decision 1624/QĐ-TTg with decision 2048/QĐ- TTg by the State Government regarding the consolidation of the board, clearly identifying its members and stipulating the following missions and legal rights and obligations:

+ Making relevant recommendations based on research with regards to the direction, planning and coming up with strategic solutions to effectively carry out PPPs in general.

+ Responsible for the conduction, supervision and delegation of tasks between ministries, departments and local authorities in the execution of PPPs.

+ Supervision of relevant ministries and departments in the construction and completion of PPP’s legal documentations. Such includes Decree 15/2015/NĐ-CP (14/02/2015) with regards to PPP investments, as well as Decree 30/2015/NĐ-CP (17/03/2015) which documents in details some regulations in Bidding Law with regards to investor selection. The board is also responsible for the revision and improvement of laws and regulations in order to better manage current PPPs.

+ Guidance provision to relevant ministries, departments and local authorities with respect to prioritized PPPs, especially in the creation and approval of such projects.

+ In charge of the ratings of PPPs and making any relevant suggestions for PPP’s laws and regulations.

2. Operational Structure – Board of Directors (State):

- The Board of Director issued decision 369/QĐ-BCĐPPP about the board’s operational structure on 29/10/2012.
